An award of joint legal custody provides both parents with equal joint responsibility of their child in making all major decisions regarding their child's education, health, and welfare. Joint physical custody usually occurs when parents to a divorce can fairly and reasonably work together to plan a custody schedule. The court may grant custody awards such as sole custody to one parent with parenting time for non-custodial parent, joint legal custody where sole physical custody awarded to one parent and parenting awarded to the other parent, joint legal and physical custody with parenting time, or a combination.

The State of New Jersey and the Court are primarily interest in children's education, health, and welfare. The Court will examine and review several nonexclusive factors pursuant to N.J.S.A. 9:2-4 in determination of an award of custody in the best interests of a child. There are a whole host of factors to be considered by the Court including a parent’s ability to communicate and cooperate in the matter involving their child, a parent’s relationship with the child, whether the parent is fit to hold custody, a parents employment, a child needs, the home environment and safety of the child. The Courts employs the best interests of a child standard in order to protect and secure the health, safety, welfare, physical and mental well-being of the child. In determining the best interest of the child, the Court will review a host of criteria including but not limited to the relations and wishes of the parents and child.
